He understands the complexities that arise before state, local, and national environmental agencies (including the U.S. Environmental Protection Agency) with regard to permitting, Clean Air Act compliance, and complex wastewater, stormwater, landfill, and storage tank regulation.

Experience

Before founding Hatchett & Hauck in 2004, Jim was an attorney at Barnes & Thornburg LLP, as well as Baker & Daniels (now Faegre Baker Daniels), both in Indianapolis, IN.  In every counsel setting, Jim has sought to be an integral part of his clients' teams.

Tom Baker

Tom Baker

Attorney

Background

Since joining Hatchett & Hauck in 2005, Tom Baker has been turning real regulatory experience into practical solutions for his clients. Prior to coming aboard the firm, he served as counsel for the Indiana Department of Environmental Management (IDEM), where he lead the IDEM legal section for contaminated property cleanup and regulation of solid and hazardous waste.

Emphasis

Tom's unique focus on property concerns—from soil contamination to creative uses of waste materials—positions him to advise clients involved in transfer, redevelopment or cleanup of contaminated land. He is particularly experienced in developing solutions for completing and paying for property cleanup, and finds that reaching agreements without litigation is often possible through his understanding of the issues and focus on his clients’ underlying business objectives.  He also uses his experience and knowledge of environmental laws and regulations to help clients to find cost-effective solutions to compliance, permitting, and enforcement issues.

Experience

Before joining Hatchett & Hauck over a decade ago, Tom's six years at IDEM prepared him not only to advise clients on remediation and waste-related issues, but also with air, water and waste permitting, enforcement issues, and litigation matters. His clients include developers, property owners, and lenders involved in the cleanup, transfer, and development of contaminated property. Tom's unique experience with IDEM’s cleanup programs, along with awareness of the latest developments in environmental law, has helped him assist clients with multi-million-dollar cleanup and expense-recovery actions against insurance companies and state environmental clean-up funds.

Education

  • University of Illinois College of Law, JD, magna cum laude (1998)
  • University of Notre Dame, BS, Chemical Engineering (1995)

Admission

  • Indiana, 1998

Involvement

When Tom isn't lecturing or writing on topics like Indiana’s Brownfields Program or underground storage tank cleanups—for which he developed several policy and legislative initiatives that expanded opportunities for local governments to redevelop contaminated properties— he may be working in his garden or playing outdoors with his children.  He shares his enthusiasm for travel and camping with his family.
